Landlords

For landlords, or those responsible for industrial doors, such as managers and supervisors, it is important to comply with legislation. The Health and Safety at Work Act 1974, section 3, states that the landlord or nominated person is responsible for the people they don’t necessarily employ as well as those they do. This covers employees and customers, as well as any other visitors to their business.

It is vital that landlords organise regular inspections and that maintenance work is carried out where necessary.

If a contractor advises that a door is unsafe then speedy action must take place to fix or replace the problem, ensuring everyone’s safety before operations can resume.

If advice is ignored, then legal action can be taken against the company. Contractors are obliged to inform a body such as the DHF, HSE or Trading Standards in order to protect themselves from blame if they have reported a problem and the company has done nothing to correct it.

Tenants and Occupiers

As a tenant residing in a commercial property, there are certain responsibilities you should be aware of under Workplace Regulations 1992. Under this act, tenants are responsible for keeping their workplace safe and in good working order for themselves and others, during the installation and maintenance of industrial doors.

They also have a responsibility for keeping anyone not employed by the company safe. If they are to spot anything dangerous or notice any faults they are to report it to a responsible member of staff immediately.
